PRIVACY NOTICE
This Privacy Notice ("Notice") explains how SENHENG ELECTRIC (KL) SDN. BHD. (hereinafter referred to as "we", "us", "our") collect, use, process, disclose and safeguard your personal data, in accordance with the requirements of Personal Data Protection Act 2010 and its subsequent amendments ("PDPA"). By accessing our official website at www.senheng.com.my ("Site"), using our Senheng App or services, participating in our activities, or voluntarily providing your personal data to us, you acknowledge that you have read, understood, and agreed to the terms of this Notice, and you consent to the processing of your personal data as described herein.
Our Site and services are not directed to individuals under the age of 18. By using our Site or providing your personal data, you confirm that you are at least 18 years of age. If you are under 18, you must obtain consent from your parent or legal guardian before providing any personal data to us.
You are entitled to exercise your rights stated below if you are not agreeable to any of the terms which have been and will be revised from time to time.
If you are aged under 18, it is required for your guardian or parent to agree to the disclosure of your personal data and agree to relevant terms in this Privacy Notice.
“Process” or “Processing” in relation to personal data means collecting, recording, holding or storing, uploading, displaying, publishing, advertising the personal data or carrying out any operation or set of operations on the personal data.
1. Collection of Personal Data
"Personal Data" refers to any information which relates directly or indirectly to you and that can be used to identify you. The types of Personal Data we may collect include, but are not limited to:
a) Name, NRIC / passport number, date of birth, gender, nationality, contact number, email address, and residential address;
b) Bank account details, credit/debit card information, payment records, purchase history, and monthly income;
c) IP address, browser type, cookies data, social media profile information (name, nickname, comments), and preferences;
d) Images, voice recordings, videos, livestreams, and physical appearance captured during events, contests, or in-store activities; and
e) Other Information such as marital status, occupation, preferred language, demographic information, and any other data relevant for the purposes listed in Clause 3 below.
2. Source of Personal Data
We may collect your Personal Data from the following:
a) When you register for a PlusOne® membership, create an account, make a purchase, participate in contests/lucky draws, submit feedback, subscribe to our communications, or interact with our customer service;
b) When you visit our Site or use our Senheng App;
c) From third-party sources, such as social media platforms (when you interact with our pages) and service providers; or
d) From Video or audio recordings taken at our premises or events for security and promotional purposes, where notice is given and consent is obtained where required.
3. Use of Cookies (and Similar Technologies)
Our Site uses cookies and similar tracking technologies to distinguish you from other users, enhance your experience, remember your preferences, analyse site traffic and personalise content. You can manage your cookie preferences through your browser settings. Disabling cookies may affect the functionality and your experience of our Site.
4. Purposes of Processing Your Personal Data
We process your Personal Data for the following purposes, which are necessary for us to provide our services and fulfil our contractual and legal obligations:
a) To process your membership registration, manage your PlusOne® account, fulfil your purchase(s), deliver product(s), process payment(s), and provide customer support;
b) To process your contest registration, verify your eligibility, manage your participation, judge entries, notify winners, and deliver prizes;
c) To communicate with you regarding your account, transactions, queries, complaints and feedback;
d) To share you information about our products, services, promotional events, contests, lucky draws, and special offers via email, SMS, telephone, or post;
e) To verify your identity, prevent fraud, and ensure the security of transactions and our systems;
f) For internal purposes such as data analysis, audits, research, statistical purposes, and developing new products and services;
g) To publish, broadcast, or upload videos, images, livestreams, or other multimedia featuring you on our Site, social media platforms, or other marketing channels for promotional, advertising, or recruitment purposes. This is subject to your separate and explicit consent as outlined in Clause 6 below; and
h) To comply with applicable laws, regulations, court orders, or requests from governmental authorities.
5. Disclosure of Personal Data
We may disclose your Personal Data to the following parties (within or outside Malaysia), strictly for the purposes stated in Clause 3 and in accordance with the PDPA:
a) Affiliates and subsidiaries within our corporate group;
b) Our Service Providers, who provide services on our behalf. We require them by contract to protect your data and not use it for their own purposes.
c) Partners involved in jointly-organized promotions, contests, or services, where you have participated in such activities.
d) Public & Marketing Channels (for the publication of winner details or multimedia content, as per the consents given under Clauses 6 and 7 below); and
e) Relevant Government & Regulatory Authorities (where required or permitted by law, regulation or court order)
When transferring data outside Malaysia, we will ensure appropriate safeguards are in place as required by the PDPA.
6. Processing of Multimedia Data (Images, Videos, Livestreams)
a) Your participation in any recording (video, image, livestream, etc.) conducted by us for the purposes stated in Clause 4(g) is entirely voluntary. You have the right to refuse participation or publication without any negative consequences.
b) If you choose to participate and sign a separate consent form (or provide equivalent affirmative consent), you authorise us to:
i) Record, capture, or broadcast multimedia content that includes your image, voice, and other personal data;
ii) Use, edit, publish, and upload such content on our Site, social media platforms, in advertisements, marketing materials, and for public viewing (including for recruitment purposes); and
iii) Retain and use the content for as long as reasonably necessary for the stated purposes.
7. Contests
Participation in our contests may require you to provide certain Personal Data (e.g., name, NRIC, contact details). Failure to provide mandatory data may result in your inability to participate.
a) By entering, you consent to the processing of your Personal Data for all contest administration purposes as per Clause 4(b) above.
b) You also acknowledge and agree that if you win, we may publish your certain personal data ("Winner's Identity") on our Site, official social media platforms, press releases, and any other advertising or promotional material related to the contest, to the extent permitted by the PDPA and other applicable laws.
8. Links to Third-Party Websites
Our Site may contain links to websites operated by third parties. This Notice does not apply to those websites. We encourage you to review the privacy policies of every website you visit before providing any personal data.
9. Your Data Subject Rights Under the PDPA
Under the PDPA, you have the following rights regarding your personal data:
a) Access: You may request access to and obtain a copy of your Personal Data held by us. However, we may be permitted by law to refuse access in certain circumstances.
b) Correction/Update: You may request to correct or update your personal data that is inaccurate, incomplete, or outdated.
c) Restriction: You may request to limit the use of your personal data, provided that such restrictions do not apply to the processing of mandatory personal data.
d) Withdrawal of Consent:
You may withdraw your consent to the processing of your Personal Data at any time, subject to legal or contractual restrictions. Please refer to Clause 10 for the consequences of withdrawing consent.
e) Deletion/Anonymisation (if necessary):
You may request to delete or anonymise your personal data, subject to applicable terms and conditions.
To exercise any of these rights, you may choose one of the following methods:
i) Contact our Customer Careline Agent (see Clause 15 "Contact Us" for details);
ii) Notify us in writing through our Customer Service Department; or
iii) If you are a PlusOne® member, you may submit a Cancellation Form available in the PlusOne® Terms and Conditions. A dedicated agent will contact you to proceed with the necessary steps.
10. Consequences of Withdrawing Consent
Except for the purpose of Clause 6, please note that withdrawing or withholding your consent for the processing of Personal Data may affect our ability to:
a) Provide you with our services or products.
b) Process your membership, contest entries, or transactions.
c) Communicate with you regarding promotions and offers.
11. Right to Opt-Out of Direct Marketing
You may request that we cease using your personal data for direct marketing purposes through:
a) unsubscribe within any of the promotional email; or
b) contacting our Customer Service
We will process your request within a reasonable period as required by the PDPA.
12. Data Security
We implement and maintain reasonable and appropriate administrative, physical, and technical security measures to protect your Personal Data from unauthorised or unlawful processing, and against accidental loss, destruction, damage, alteration, or disclosure. Access to your Personal Data is restricted to authorised personnel on a need-to-know basis. We regularly review our security policies and procedures.
13. Data Retention Period
We will retain your Personal Data only for as long as is necessary to fulfil the purposes for which it was collected, to fulfil the purposes for which it was collected or to comply with legal, regulatory, or accounting requirements. Upon expiry of the retention period, or when the data is no longer required, we will take reasonable steps to permanently delete, destroy, or anonymise the data.
14. Additional Conditions:
a) As a subscriber of our Site, you may correct or update your personal data by clicking on the 'My Account' link at the top of any page, entering your ID, password and birth date when prompted and clicking the Edit Information button. The changes you make will be reflected in our databases instantly.
b) Any request made under Clause 9 shall be subject to PDPA and all relevant regulations.
c) We reserve the right to review and amend this Notice from time to time to reflect changes in our practices, services, or legal requirements. The updated Notice will be posted on our Site with a revised effective date. Your continued use of our Site, App, or services after such posting constitutes your acknowledgment and acceptance of the changes.
