Introduction

  • The aforesaid Campaign is organized by Samsung Malaysia Electronics (SME) Sdn. Bhd. ("Samsung"). The terms and conditions and the Privacy Policy (as mentioned below) will be construed as the terms and conditions ("Terms and Conditions") of this Campaign on which Samsung offers you ("Customer") access to and use of this site for the purposes of this Campaign.
  • The sale transaction in this Campaign is between the Participating Outlet(s) (as defined below) and Customer. Samsung only provides the recommended retail price ("RRP") and guidance on this site.
  • Customers agree to comply with all the above when accessing or using this site. The scope of these Terms and Conditions is limited to Samsung's role of hosting this site and organizing this Campaign only.

Campaign

  • By participating in the Campaign, Customer will be entitled to the following launch promotions, exclusive for the purchase of Samsung Galaxy Note20 (RRP: RM3,899), Samsung Galaxy Note20 5G (RRP: RM4,299) or Samsung Galaxy Note20 Ultra 5G (RRP: RM5,199) only:-
    • Promotion A: Samsung Galaxy Note20 Gift-with-Purchase Launch Campaign

      Customer is entitled to Free Gifts which consist of one (1) Samsung UV Sterilizer with Wireless Charging (RRP: RM299) and Samsung Wireless Charger Convertible (RRP: RM209), with every purchase of Samsung Galaxy Note20, Samsung Galaxy Note20 5G or Samsung Galaxy Note20 Ultra 5G. Customers are entitled to the said Free Gifts upon the purchase of the participating models at the point of purchase.

      The following are the two (2) steps for Samsung UV Sterilizer with Wireless Charging and Samsung Wireless Charger Convertible redemption:

      • Step 1: Make a Purchase

        Customer to walk in to any Participating Outlets and purchase the Samsung Galaxy Note20, Samsung Galaxy Note20 5G or Samsung Galaxy Note20 Ultra 5G.

      • Step 2: Collect Samsung UV Sterilizer with Wireless Charging and Samsung Wireless Charger Convertible from Participating Outlet

        Customer to collect the Samsung UV Sterilizer with Wireless Charging and Samsung Wireless Charger Convertible immediately upon purchase of the preferred device model.

        The Free Gifts of Samsung UV Sterilizer with Wireless Charging and Samsung Wireless Charger Convertible are limited to the first 29,000 Customers nationwide for the participating device models, at Participating Outlets on a first-come, first-served basis and also subject to stock availability in each Participating Outlets. The Samsung UV Sterilizer with Wireless Charging will be available in White only, and the Samsung Wireless Charger Convertible will be available in Black only. Samsung reserves the right to modify the quantity or the colour of the said Free Gifts at its sole discretion, without any prior notice.

    • Promotion B: Samsung 50” UHD Smart TV Redemption Program

      Subject to fulfilment of all criteria set out herein, eligible Customer is entitled to redeem one (1) unit of Samsung 50” UHD Smart TV (RRP: RM2,599) from Samsung Redemption Management System ( “RMS”):https://samsung-redemption.com/customer/#/sasso/MY-gwp-60.

      The following are the six (6) steps for the Samsung 50” UHD TV redemption:

      • Step 1: Make a Purchase

        Purchase the Samsung Galaxy Note20, Samsung Galaxy Note20 5G or Samsung Galaxy Note20 Ultra 5G.

      • Step 2: Read and Agree the Terms and Conditions

        Visit https://samsung-redemption.com/customer/#/sasso/MY-gwp-60 from 1st September 2020, 12:00 p.m. onwards and redemption will close on 5th September 2020, 11:59 p.m. Redemption is on a first-come, first-served basis, while stocks last.

      • Step 3: Register an Account

        Create an account or Login with Samsung Account.

      • Step 4: Redemption Details

        Fill in necessary details at the redemption page and upload a clear image of proof of purchase/receipt with device IMEI stated.

      • Step 5: Verification of Redemption

        Samsung will verify the validity of the redemption claim and send an email to Customer to inform them if redemption submission is received.

      • Step 6: Delivery

        The Samsung 50” UHD Smart TV will be delivered to successful Customers (who first completed their redemption submissions with all required information and documents) within 30 days from the confirmation of successful redemption.

      • The redemption submission period of the Samsung 50” UHD Smart TV for this Campaign will begin from 1st September 2020 (Tuesday), 12:00 p.m. to 5th September 2020 (Saturday), 11:59 p.m. Redemption submission after 5th September 2020 (Saturday) will be disqualified and considered null and void. Samsung shall not be liable if the Customer fails to submit or complete the redemption. Samsung reserves the right to modify the quantity, extend or shorten the redemption period at its sole discretion without any prior notice.
      • The redemption submission must be made through RMS at https://samsung-redemption.com/customer/#/sasso/MY-gwp-60. The Free Gift is limited to the first 1,200 Customers nationwide (including Pre-Order Customers) who first completed their redemption submissions with all required information and documents on a first-come, first served basis while stocks last (hereinafter referred to as “Eligible Customers”).
      • Customer is required to fill in the Recipient Name in RMS same as the Customer Name in proof of purchase/receipt with device IMEI stated attached in RMS. Samsung reserves the right to disqualify any customer’s redemption if the Customer’s details and proof of purchase/receipt submitted by Customer is unclear, false or incomplete or if there is failure to provide the information or document(s) required.
      • Customer will receive an email from Samsung on notification of receipt of redemption submission once Customer has completed the steps in RMS. This is not a confirmation of redemption. Completion of RMS submission does not guarantee Customer’s entitlement for the Free Gift.
      • Eligible Customer who fulfills the criteria for the Free Gift will receive Delivery – Started Email from Samsung and the Free Gift will be delivered to Customer as per the details submitted by Customer within 30 working days upon receiving the Delivery – Started Email.
      • The delivery of Samsung 50” UHD Smart TV is on a “first-come, first-served” basis. Samsung reserves the right to change the delivery date of Samsung 50” UHD Smart TV to Customer without prior notice.
      • The redemption of Samsung 50” UHD TV is limited to one (1) Customer per delivery address. For Customer that purchases more than one (1) unit of Samsung Galaxy Note20 series, or purchases with more than one (1) unit of the Galaxy Note20 series with the same delivery address, the Customer is only entitled to enjoy only one (1) unit of Promotion B.

        e.g 1. For Customers that purchase one (1) unit of Samsung Galaxy Note20 and one (1) unit of Samsung Galaxy Note20 Ultra 5G, Customer will be entitled to:

        • Two (2) units of Samsung UV Sterilizer with Wireless Charging
        • Two (2) units of Samsung Wireless Charger Convertible
        • One (1) unit of Samsung 50” UHD Smart TV (provided that he/she fulfils all criteria mentioned herein)

        e.g 2. Customer A purchases two (2) units of Samsung Galaxy Note20 and Customer B purchases one (1) unit of Samsung Galaxy Note20 Ultra 5G, and both Customer A and Customer B lives at the same address, only one (1) Customer will be entitled to the redemption of Samsung 50” UHF Smart TV. Samsung will honour the Customer that has the earliest successful redemption with only one (1) unit of Samsung 50” UHD Smart TV per delivery address.

    • Promotion C: Samsung Galaxy Note20 Trade-Up Program
      • Customer is entitled to trade-in their old smartphone (“Devices”) at a trade-in value specified by CompAsia and set-off that value to purchase a unit of Samsung Galaxy Note20, Samsung Galaxy Note20 5G or Samsung Galaxy Note20 Ultra 5G within the same transaction at Participating Outlets.
      • The Customer is entitled to only one (1) time of trade-in for every purchase of a Samsung Galaxy Note20, Samsung Galaxy Note20 5G or Samsung Galaxy Note20 Ultra 5G.
      • The trade-in transaction is between CompAsia and customers whereby CompAsia shall determine the trade-in value using its digital application, i.e. SmartExchange App in accordance with the terms and conditions set out herein. Samsung is merely acting as the coordinator for the trade-in transaction.
      • The Samsung Galaxy Note20 Trade-Up Program will run from 17th August – 31st October 2020 (“Campaign Period”) during operation hours of Participating Outlets. Samsung shall reserve the right to shorten or extend the Campaign Period at its sole discretion without any prior notice.
      • The list of eligible devices in Appendix A can be traded-in by the Customer at a value specified by CompAsia subject to the Terms and Conditions stated below:
        • The values provided in the list are indicative, for devices that are fully functional with no physical damage whatsoever. Values will differ if there is any physical or functional damage identified, or when market value of the devices fluctuate. The accurate value of the trade-in device will be determined after assessment using CompAsia’s SmartExchange App in-store.
        • The SmartExchange App shall compute and provide a quotation through a series of automated tests, user-assisted tests and user-declared conditions. The actual trade-in value quotation shall be computed according to the types and quantity of defects found. During the device inspection by sales staff, should the sales staff find any mismatch between the actual and declared condition of the device, a revised trade-in value will be offered. If Customer is agreeable, the trade-in transaction shall be completed with this revised trade-in value. Otherwise, the device will be returned without any charges/ payment.
        • Personal device locks (PIN, passcode, fingerprint, facial) and accounts (iCloud, Find my iPhone, Google, Samsung) must be removed before the trade-in of device happens. Any locked device will not be accepted.
        • Selected trade-in devices are eligible for an additional top-up value (overtrade), which will increase the trade-in value of the device. Customer can bring the device to Participating Outlets to confirm the trade-in value of the device.
        • Devices not in the list may be eligible for trade-in. Customer can bring the device to Participating Outlets to confirm the eligibility of the device for trade-in. If eligible, the device trade-in value will be according to the SmartExchange App.

Campaign Period

  • Promotion A: Samsung Galaxy Note20 Gift-with-Purchase Launch Campaign

    21st August 2020 (Friday) – 31st October 2020 (Saturday), during operating hours of Participating Outlets

  • Promotion B: Samsung 50” UHD TV Redemption Program

    1st September 2020 (Tuesday), 12:00 p.m. – 5th September 2020 (Saturday), 11.59 p.m.

  • Promotion C: Samsung Galaxy Note20 Trade-Up Program

    17th August 2020 (Monday) – 31st October 2020 (Saturday), during operating hours of Participating Outlets

Eligibility

  • The Campaign is open to all Malaysian Citizens and residents of Malaysia of 18 years old and above (as of 17th August 2020) with Malaysia Identity Card or a valid passport; except Samsung's employees (and their immediate families).

Customer's Covenants

In connection to this Campaign, Customer will not use this site:

  • To submit fraudulent order, false, inaccurate, misleading, defamatory, or libellous information;
  • To distribute viruses or any other technologies that may harm Samsung, or the interests or property of other users;
  • To export the unit purchased except in compliance with the export control laws of relevant jurisdictions and in accordance with posted rules and restrictions;
  • In the event if Samsung suspects or discovers that the Customer is abusing this Campaign and/or Samsung in any of the ways mentioned above or otherwise, Samsung may, at our sole discretion, take necessary steps to prevent and mitigate such abuse such as limiting, suspending, or terminating the Customer's user account(s) and access to this site, delaying or removing hosted content, removing any special status associated with Customer account(s), reducing or eliminating any discounts, and taking technical and/or legal steps to prevent Customer from using this site.

Limitation of Liability

  • Samsung uses its reasonable effort to keep its site safe, secure, and functioning properly, but Samsung does not guarantee the continuous operation of or access to this site.
  • Customer agrees that he/she is making use of this site at his/her own risk, and that it is being provided to Customer on an "AS IS" and "AS AVAILABLE" basis.
  • To the extent permitted by applicable law, Samsung excludes all express or implied warranties, terms and conditions including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Customer shall assume full responsibility in case of any accident, damage or claim resulting from participating in this Campaign.
  • Customer shall be deemed to be able to perform legally binding contract and there shall not be any refund or costs whatsoever arising from his/her violation of the minimum age stated herein.
  • Warranty of the Samsung Galaxy Note20, Samsung Galaxy Note20 5G and Samsung Galaxy Note20 Ultra 5G is subject to standard product warranty coverage as per terms and conditions stated in the official corporate website at http://www.samsung.com/my/support/warranty. Customer is advised to check the website from time to time and stay informed for any changes on the terms and conditions of the warranty.
  • All transportation, personal costs and/or any other costs, fees and/or related expenses arising out of the collection of the phone are the Customer's sole responsibility.

Indemnity

  • Customer will fully indemnify and hold Samsung (and our affiliates and subsidiaries, and our and their respective officers, directors, employees, agents) harmless from any claim or demand, including reasonable legal fees, made by himself/herself or any third party due to or arising out of his/her breach of these Terms and Conditions, improper use of the site or breach of any law or the rights of a third party.

Privacy

  • By providing Customer's personal data, Customer is indicating that he/she has read, understood and agreed that his/her personal data will be recorded, stored or otherwise processed in accordance to Samsung's Privacy Policy available at http://www.samsung.com/my/info/privacy.html

General

  • In the event Customer have queries with regard to the Campaign; please call Samsung helpline at 1-800-22-8899 for clarification.
  • Samsung reserves the right to make amendments to the Terms and Conditions of the Campaign herein without prior notice.
  • The Free Gifts in this Campaign are not redeemable for cash, not exchangeable, transferable, or refundable, and cannot be used in conjunction with other promotional offers at the Campaign.
  • Samsung reserves the rights to change or replace the Free Gifts/promotion items with products of similar value without prior notice.
  • All pictures and/or images of the Free Gifts found in any advertising and marketing materials are for illustration purposes only and may be different from the actual products.
  • Samsung reserves the right to disqualify or reject any submissions/redemptions for the Free Gift redemption in our sole discretion, in the event of violation of any of the Terms and Conditions.
  • In the event of any discrepancies between the information that Customer has submitted with regards to the redemption of Free Gift and for any reasons whatsoever, Samsung shall not be responsible for any loss or costs arising from such discrepancies howsoever caused.
  • In the event of an electronic, computer, operational and/or technical error affecting the details or pricing or quantity of the product or any promotion on the website, Samsung reserves the absolute rights to rectify such error and/or cancel any transaction which has been entered into in reliance of the said error.
  • By participating in this Campaign, Customer fully and unconditionally agrees to and accepts Samsung's Privacy Policy as stated above, and the Terms and Conditions.
  • By placing registering an account for the Free Gift redemption, Customer agrees to grant Samsung and their respective parent companies, subsidiaries, affiliates, licensees, directors, officers, agents, independent contractors and advertising/promotion agencies the use of his/her full details submitted through the Campaign, without further compensation, unless prohibited by law.
  • In the event of inconsistencies between the terms and conditions found elsewhere with regard to this Campaign (if any) and the Terms and Conditions herein, the latter shall prevail.
  • These Terms and Conditions herein shall be governed by the laws of Malaysia and the jurisdiction of the courts of Malaysia.
